Terms of Use

BI.Design ("BI.Design", "We", or "Platform") is a specialized design solution for Business Intelligence professionals, providing dashboard prototyping tools, a BI component library, a collaborative template repository, and professional export features (collectively, the "Services").

These Terms of Use govern your access to and use of the Services. By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.

ATTENTION: IF YOU DO NOT AGREE TO THESE TERMS OF USE, YOU SHOULD NOT USE BI.DESIGN SERVICES.

Definitions

• "Content": Any material created, submitted, or published by the User on the Platform, including projects, designs, layouts, templates, and other files.
• "Platform": The BI.Design technological environment, including the prototyping editor, component library, template repository, and all features accessible at https://bidesign.app/.
• "Repository": The collaborative area of the Platform where Users can publish and clone community-created dashboard templates.
• "Services": The full set of features offered by BI.Design, as described on the Platform and in these Terms.
• "User": Any individual who accesses or uses the BI.Design Platform.

1. Account Creation and Eligibility

1.1. To use the Services, you must create a User Account. Access requires a device with an internet connection compatible with the Platform's minimum requirements.

1.2. You must register with a valid email address and create a strong password. BI.Design may offer authentication via third-party identity providers (such as Google) where available.

1.3. You are responsible for maintaining the confidentiality of your credentials and must not share them with third parties. If you suspect unauthorized access to your account, contact us immediately at hello@bidesign.app. You are responsible for all activities that occur under your account.

1.4. The Services are intended solely for individuals with legal capacity to enter into contracts. Use by minors under 18 requires parental or guardian consent and supervision.

1.5. If your account remains inactive for an extended period, you will be notified before it is closed. You may also close your account at any time through Platform settings or by contacting support.

1.6. Certain provisions of these Terms survive account termination, including those relating to Intellectual Property, Content License, Disclaimer of Warranties, Limitation of Liability, and General Provisions.

2. License and Intellectual Property

2.1. The Platform, including its software, editor, interface, BI components, and repository structure, is the exclusive property of BI.Design and is protected by applicable intellectual property law. Subject to your compliance with these Terms, BI.Design grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services solely for your professional dashboard prototyping purposes.

2.2. You may not copy, modify, distribute, reverse engineer, create derivative works from, or sell any part of the Services, software, or Platform content without prior written authorization from BI.Design.

2.3. BI.Design is not responsible for content generated by Users or third parties. The Services may contain links to third-party sites or platforms over which BI.Design has no control.

2.4. BI.Design may update these Terms at any time by publishing the revised version on the Platform. Significant changes will be communicated by email at least 30 days in advance. Continued use of the Services after changes are published constitutes acceptance of the new Terms.

3. Personal Data

3.1. BI.Design processes personal data exclusively in accordance with its Privacy Policy, available at https://bidesign.app/privacy-policy.

3.2. Projects and designs you create on the Platform are treated as confidential and remain your property, as described in Section 6 and the Privacy Policy.

4. Prohibited Conduct and User Obligations

4.1. The following conduct is prohibited:

• Violating any applicable local or international law or regulation;
• Impersonating any person or entity;
• Publishing or transmitting illegal, offensive, defamatory, discriminatory, or privacy-violating content;
• Publishing or transmitting content that infringes third-party intellectual property rights;
• Sending unauthorized advertising, spam, or promotional materials;
• Uploading viruses, malware, or any malicious code that could compromise the Platform or other Users;
• Using the Services for unlawful or fraudulent purposes.

4.2. User obligations include:

• Maintaining adequate devices and internet connectivity at your own expense;
• Keeping your registration information accurate and up to date;
• Respecting the intellectual property rights of BI.Design and third parties;
• Holding BI.Design harmless from any claims arising from your misuse of the Services.

5. Account Security

5.1. To protect your account, we recommend:

• Using a strong, unique password and enabling two-factor authentication when available;
• Never sharing your login credentials with anyone;
• Keeping your devices and browsers updated with the latest security patches;
• Always verifying you are on the official address https://bidesign.app/ before entering credentials;
• Contacting hello@bidesign.app immediately if you suspect unauthorized access.

6. Content Ownership and License

6.1. You retain full ownership of all Content you create on the Platform. BI.Design makes no claim of ownership over your designs or prototypes.

6.2. By using the Services, you grant BI.Design a non-exclusive, worldwide, royalty-free license to store, process, and display your Content solely to operate, provide, and improve the Services. This license ends when you delete the Content or close your account, subject to applicable legal exceptions.

6.3. By voluntarily publishing a template to the Repository, you grant other Platform Users the right to view and clone that template for use in their own projects, within the limits of the Platform's available features. You are responsible for ensuring you hold all necessary rights to any Content you publish.

6.4. You are solely responsible for all Content you create or publish and warrant that it does not infringe any third-party rights or applicable law. BI.Design may remove Content that violates these Terms.

7. Plans and Subscriptions

7.1. BI.Design offers the Explorer, Creator, and Professional plans, each with distinct features and limits as described on the Platform. The Explorer plan may be available free of charge as an entry point. Advanced features require a paid plan. BI.Design reserves the right to modify plan features, limits, or pricing with prior notice to Users, as detailed in Clause 7.4.

7.2. Subscriptions are billed automatically at the time of purchase and at the start of each new billing cycle (monthly or annual), which may occur up to 24 hours before the cycle begins. Applicable prices are those displayed on the Platform at the time of purchase.

7.3. You may cancel your subscription at any time through Platform settings. Cancellation takes effect at the end of the current billing period, with no pro-rated refund for the remaining period, unless otherwise required by law.

7.4. In case of price changes, you will be notified by email at least 30 days in advance. New prices apply from the next billing cycle. If you disagree, you may cancel before renewal.

7.5. BI.Design may offer promotional coupons or free access for limited periods, subject to the specific conditions stated at the time of the offer.

8. Disclaimer of Warranties and Limitation of Liability

8.1. The Services are provided "as is" and "as available." BI.Design does not guarantee that the Services will be uninterrupted, error-free, or delay-free. BI.Design may add, modify, or remove features and may suspend or discontinue the Services for technical, legal, or operational reasons.

8.2. BI.Design is not liable for indirect damages, lost profits, data loss, or any other losses arising from the use or inability to use the Services, to the extent permitted by applicable law.

8.3. You acknowledge that the Services depend on third-party technologies and infrastructure, and that outages or interruptions outside BI.Design's control may occur.

9. General Provisions

9.1. You may contact BI.Design at hello@bidesign.app.

9.2. BI.Design may send service-related communications by email or Platform notification, including operational updates, new features, and other relevant information.

9.3. BI.Design's failure to enforce any provision of these Terms shall not constitute a waiver of rights or a precedent for future situations.

9.4. If you breach these Terms, BI.Design may suspend or terminate your account without compensation or refund for unused Services.

9.5. These Terms are governed by Brazilian law. Any disputes shall be subject to the jurisdiction of the courts of São Paulo, Brazil, without prejudice to consumer rights under applicable consumer protection law.
